U.S. safety regulators open probe of VW SUVs for lighting issue
Nov 8th 2013, 12:40

DETROIT Fri Nov 8, 2013 7:40am EST

DETROIT Nov 8 (Reuters) - U.S. safety regulators have opened an investigation into an estimated 61,000 Volkswagen Tiguan sport utility vehicles in the United States after receiving complaints about the loss of exterior lighting.

The National Highway Traffic Safety Administration said it opened the preliminary evaluation into the compact SUVs from model years 2009 through 2011 after receiving 26 complaints from consumers about partial or complete loss of exterior lights, including headlights, brake lights and turn signal lights, due to a heat-damaged electrical fuse.

"The reports suggest the problem worsens over time with additional exterior lighting malfunctioning as the problem progresses," according to the NHTSA document. "Most of the complaints report finding an overheated and melted fuse in the under-hood fuse box. The overheated 30-amp fuse protects, among other things, several exterior lighting circuits."

There were no accidents or injuries related to the issue listed in the NHTSA document posted online. A Volkswagen AG spokeswoman said the German automaker is cooperating with the agency's investigation.

A preliminary evaluation is the first step in a process that can lead to a recall should regulators determine that a manufacturer needs to address a safety issue.

Ukraine acts to prepare anti-corruption agreement, says EBRD
Nov 8th 2013, 10:51

KIEV Fri Nov 8, 2013 5:51am EST

KIEV Nov 8 (Reuters) - Ukraine has renewed a push for agreement with the European Bank for Reconstruction and Development to fight corruption after President Viktor Yanukovich's commitment to improving the business climate was criticised, a bank official said on Friday.

The ex-Soviet republic, which hopes to sign agreements on association and free trade with the European Union at the end of the month, backed away this week from inking the Anti-Corruption Initiative with the EBRD aimed at ending corruption and extortionate business practices which deter investment.

The delay led to dismay among members of the foreign investment community who heard Yanukovich tell a regional economic forum on Wednesday his government intended to deliver a "powerful and systematic attack on corruption in the country".

But an EBRD official said on Friday the bank had now learned that an order had been issued to all government ministries to agree quickly a text of a memorandum of understanding that could be signed with the international lender by Nov. 20.

"We understood that they (the government) will intensify efforts to agree the initiative. Events have marshalled thoughts on this. We would welcome this renewed focus," the EBRD source said. There was no immediate comment from the government.

The international lender invests about $1 billion a year in Ukraine and the EBRD says the delay in signing the initiative - officially because of "technical reasons" - is costing the country hundreds of million of euros in lost EBRD investment.

Commentators say this is not money that Ukraine can afford to pass up lightly, as it faces threats of retaliatory trade action from its biggest partner Russia which has been angered at Kiev's course towards a new trading relationship with the EU.

A text of the draft memorandum of understanding, seen by Reuters, envisages an independent body being set up to examine complaints from companies working in Ukraine about the way they are treated by tax and customs officials and the courts.

Businesses, ranging from the large to the very small often face extortionate demands for hefty bribes and the threat of corporate raiding.

As Ukraine moves towards signing the landmark agreements with the EU on Nov. 28, the EBRD is pushing it to take more robust action to improve the work climate for investors and businesses.

"If the investment climate is right then we have a potential strong pipeline for investment in the country," the EBRD said.

UPDATE 1-Southwest Air can file brief in US Air-American Airlines case
Nov 8th 2013, 02:36

Thu Nov 7, 2013 9:36pm EST

Nov 7 (Reuters) - A U.S. judge on Thursday gave Southwest Airlines permission to file a brief asking that US Airways Group and American Airlines be required to give up take-off and landing slots at key U.S. airports should they merge.

Southwest has expressed interest in acquiring rights at New York's LaGuardia and Reagan National Airport near Washington that could become available if the merger goes ahead.

In a statement, the Dallas-based carrier said its filing would explain the benefits it could offer consumers should it be allowed to expand at those airports. The judge hearing the case said the brief must be filed no later than Nov. 15.

The Justice Department filed a suit in August to block the merger between American Airlines. U.S. Airways and Attorney General Eric Holder said this week the government wanted the carriers to shed slots at Reagan National and other "key" U.S. airports.

Holder said he hoped to reach an agreement settling the matter before a federal trial is due to start Nov. 25.

American and US Airways declined to comment on Thursday.

US Airways told its shareholders in July that Southwest and JetBlue Airways were pushing hard to influence regulators to require it and American to shed slots in the merger that would form the world's biggest carrier. .

JetBlue told the Reuters Aerospace and Defense Summit in September that a merged American and US Airways should not have a share of slots at Reagan National that exceeds US Airways' current standalone share, which is about 55 percent .

Other U.S. carriers have cited potential benefits from the merger. Allegiant Travel, a Las Vegas-based low-cost carrier that serves leisure destinations, said on Thursday it would consider opportunities to acquire airport slots that might open up as a result of the merger.

"We would certainly consider any and all opportunities, however, ultimately economics are a significant consideration for us in any market," Allegiant spokeswoman Jessica Wheeler said in an email.

"We anticipate that the merger would create a healthy network carrier that would focus on the needs of business and international travelers, opening up growth opportunities in U.S. leisure markets for leisure-focused carriers such as Allegiant," Wheeler said.

UPDATE 3-Washington state takes steps to nail down Boeing 777X contract
Nov 8th 2013, 00:33

* Boeing seeking tax incentives and new 8-year labor contract

* Unclear if company would settle for less than full legislative package

* Investors not concerned about placing 777X production in Washington

By Jonathan Kaminsky and Alwyn Scott

OLYMPIA, Wash./ NEW YORK, Nov 7 (Reuters) - The Washington state legislature met on Thursday in a special session to consider tax breaks aimed at ensuring Boeing Co builds its newest jet, the 777X, in the Seattle area.

Washington Governor Jay Inslee, a Democrat, called the session to seek roughly $8 billion in tax incentives along with a streamlined permitting process for Boeing and $10 billion in funding for transportation improvements.

But to win the coveted work for Washington, Boeing's machinists must ratify a long-term labor contract with concessions on pensions and healthcare.

The 777X program would secure thousands of jobs in the state, keep it at the forefront of aircraft technology and trigger construction of 1.5 million square feet (139,355 square meters) of new facilities in the Puget Sound area. It is viewed as crucial to the Seattle area, which is competing with nonunionized workers in southern U.S. states where wages are lower.

"Assembly of that airplane will be the lynchpin of economic growth for the state of Washington for decades to come," Inslee said, speaking before the Washington state House Finance Committee on Thursday.

It remained unclear exactly how much Boeing's decision about where to build the jet really hinges on the labor deal and the state incentives.

A union "letter of understanding" distributed to members says Boeing "agrees to locate" 777X production in Washington if workers approve a new, eight-year labor contract.

The document makes no mention of the deal depending on legislative action, raising the question of whether the airplane maker could be locked into production of its newest jet in Washington state with no new tax incentives or other inducements.

Inslee spokesman David Postman insisted both measures are essential to the deal, characterizing the letter as nonbinding and noting it does not take into account other agreements.

His view was backed up by a statement from the union, forwarded to Reuters by the governor's office.

"Any suggestion that the union thinks Legislative action isn't necessary is simply wrong," said Larry Brown, the machinist union's legislative director, in the statement.

The 777X is Boeing's latest jet program, and could be the last major new plane by Boeing for the next 15 years. It is expected to enter service in 2020.

The jet will be built using a metal fuselage similar to the current 777, one of Boeing's best-selling planes, and will add a large new carbon-composite wing and new engines. More than 100 orders for the jet are expected later this month at the Dubai Airshow.

In a letter to Inslee sent on Thursday, the senior vice president of Boeing's government operations, Tim Keating, listed tax incentives and the transportation infrastructure package, along with a labor agreement, as elements "that will ensure our lasting competitiveness in Washington state."

The letter went on to commend the governor for working to "achieve the results that are necessary" to locate 777X production in Washington state.

"That doesn't mean it's a deal-breaker," if the legislation doesn't pass, said Ken Herbert, an aerospace analyst at Canaccord Genuity Inc in San Francisco.

OTHER CONSIDERATIONS

Boeing clearly wants to lock in the labor concessions but might be more flexible on the legislative proposals, Herbert said.

The Chicago-based planemaker has also considered putting the 777X at its South Carolina assembly plant, where it makes some 787 Dreamliners, according to industry sources.

Putting the 777X there was seen by many industry experts as more financially sound for the long haul. But the labor proposal shows determination to control costs and avert strike risk with the 777X in Washington.

A newspaper in South Carolina reported on Thursday that officials there never seriously considered that their state was in the mix for winning the work.

Boeing also is under pressure to avoid the technical problems and delays that plagued the Dreamliner, which arrived three years late after production was outsourced around the world.

"It would almost certainly have been more disruptive to move a larger component of the (777X) operations to South Carolina," said Russell Solomon, an analyst at Moody's Investors Service in New York.

So far, investors are not concerned about the tilt toward building the jet in Washington.

Boeing stock is near record highs, and has not fallen significantly since the provisional proposals were announced on Tuesday. The shares ended down 1.2 percent at $131.51 on Thursday on the New York Stock Exchange.

"Investors care about stability, visibility, profitability and risk in the assembly of aircraft," said Rob Stallard, an analyst at RBC Capital Markets. "If the location of final assembly impacts these factors, then they probably care."

The provisional labor agreement with the machinists' union was announced on Tuesday. The eight-year contract includes $10,000 signing bonuses and enhanced pensions for older workers who opt to retire, but would halt further additions to current workers' pensions and set up a different retirement plan funded by the company, the union said.

Union members are due to vote on the proposal by next Wednesday.

Inslee's plan includes extending commercial airplane tax incentives passed in 2003 until 2040 and widens other exemptions.

The 2003 tax incentives were for Boeing locating the 787 in Washington, and figure prominently in a trade dispute between Boeing and rival Airbus, and were ruled unfair by the World Trade Organization (WTO).

Similarly, Washington has criticized Airbus for continuing to take government loans for the A350 aircraft that the United States says were ruled illegal by an earlier WTO case.

Democrats control the state's legislature's lower house, and Republicans control the Senate. Sentiment in both chambers leans toward passing Boeing-related tax incentives.

But state Senate Majority Leader Rodney Tom, a conservative Democrat, cautioned it could take weeks to pass a transportation revenue package that would likely rely on a gasoline tax increase.

It was not immediately clear whether Boeing views swift passage of a transportation package as a prerequisite to locating 777X production in Washington state and building new facilities in the Puget Sound area.

"It's not do-or-die to get the transportation package done immediately," Tom said.

Reuters: Regulatory News: Treasury's Massad to head U.S. swaps regulator -source

Treasury's Massad to head U.S. swaps regulator -source
Nov 8th 2013, 00:40

WASHINGTON Nov 7 (Reuters) - Timothy Massad, the Treasury official who leads the U.S. bank bailout program, is about to be selected as the new chair of the country's derivatives regulator, a source familiar with the matter said.

In nominating Massad as chairman of the Commodity Futures Trading Commission, President Barack Obama would pick someone who has earned his spurs during the 2007-09 financial crisis as head of the $700 billion Troubled Asset Relief Program.

The nomination would be a last-minute solution to avoid a leadership vacuum at the CFTC, which saw its powers vastly expanded after the crisis, when it was put in charge of the $630 trillion swaps market.

The Treasury declined comment. The White House did not immediately return a request for comment. If nominated, Massad would still need to be confirmed by Congress.

Chairman Gary Gensler's term at the agency finishes on Jan. 3 of next year, but the agency still faces a big task in finishing many of the rules under the 2010 Dodd-Frank act to reform Wall Street's investment banks.

An earlier contender for the job, Amanda Renteria, a former chief of staff for Senator Debbie Stabenow, the head of the Senate Agriculture Committee, withdrew her name in July, saying she was returning to California.

The last-minute search risked leaving the CFTC rudderless just as it starts overseeing vast new markets and is rushing to write crucial new regulations such as the Volcker rule, which bars banks from gambling with their own money.

The Treasury said last month that Massad would leave his post later this fall, although without elaborating. Because he is already in a senior government position, lobbyists said at the time that any vetting process could move quickly.

Massad was a partner at New York-based law firm Cravath, Swaine & Moore LLP for 17 years. While on leave from the firm in late 2008 and early 2009, he was also a special legal adviser to a congressional panel on economic stability.

He joined the Treasury in May 2009 as the chief counsel for the Office of Financial Stability.

Massad took over the TARP program three years ago, and has been working most recently to unwind investments the Treasury made during the financial crisis.

TARP, enacted in October 2008, was used to prevent a collapse of the U.S. financial system. It injected capital into hundreds of banks, including Goldman Sachs Group Inc, Citigroup Inc and Bank of America Corp and was used to bailout insurer American International Group Inc .

Obama was also expected to soon fill another top role at the agency, lobbyists and other agency watchers said this week, after Democratic Commissioner Bart Chilton unexpectedly announced his departure at a meeting this week.

Sharon Bowen, a partner at law firm Latham & Watkins in New York, was being vetted as a successor and her name and Massad's would be made public soon, these people said.

Chris Giancarlo, a senior manager at New-York based derivatives broker GFI Group Inc, still has to be confirmed by the Senate after Obama nominated him to fill a third, Republican, position at the CFTC.
